Mechanic’s Lien Deadlines for Syracuse Construction Projects

For a Syracuse construction project, identify the type of work and property before calculating a mechanic’s lien deadline. The date of an invoice or payment demand does not necessarily start the filing period.

  • Most private improvements: generally eight months from the last qualifying labor or materials.
  • Single-family improvements: generally four months, subject to the specific developer-owned subdivision exception. A two-family property is not automatically subject to the four-month period merely because it is residential.
  • Retainage: a separate period of 90 days after retainage was due to be released.
  • New York public improvements: filing is permitted before completion and acceptance and within 30 days after both have occurred.

Sources: Lien Law § 10 and § 12. Condominium units, common elements, cooperative interests and development projects require a factual review; a shorthand project label can produce the wrong answer.

Filing is only one deadline

For private liens, owner and specified contracting-party service generally must occur within five days before or 30 days after filing, with required proof filed within 35 days after the notice. See § 11 and § 11-b. Public-lien service and proof follow the different timing in § 11-c.

A private lien generally lasts one year unless properly continued or enforced under § 17. Single-family extensions require a court order. Address extension or foreclosure before the current lien expires and review any demand requiring earlier enforcement.
